These Terms of Use govern access to and use of the website staecnon.org.br ("Site"), owned by the Union of Sanitation Workers of the North and Northwest of the State of Rio de Janeiro (STAECNON-RJ), registered under CNPJ No. 28.980.464/0001-20, headquartered at Rua Marechal Floriano, 147, Centro, Campos dos Goytacazes/RJ, ZIP code 28010-166 ("Union").
By accessing or using any part of the Site — including browsing the public content, filling out the contact form or using the Reporting Channel — you declare that you have read, understood and fully agree to these Terms of Use and to the Privacy and Cookie Policy. If you do not agree with any part of these Terms, you must immediately stop using the Site.
1. ACCEPTANCE OF THE TERMS
Use of the Site, in any of its features, implies full, express and unrestricted acceptance of these Terms of Use, in force on the date of access. We recommend reading these Terms whenever you use the Site, since they may be updated periodically (see item 15).
2. DEFINITIONS
- Site: the portal staecnon.org.br and all its subdomains, pages, systems and features, including the Administrative Panel and the Reporting Channel;
- User: any person who accesses or uses the Site, whether or not associated with the Union;
- Member: a worker affiliated with STAECNON-RJ, under the terms of the Bylaws;
- Access Account: credentials (e-mail and password) that allow an authorized User to authenticate in a restricted area of the Site, such as the Administrative Panel;
- Reporting Channel: a feature of the Site intended for reporting cases of workplace bullying, sexual harassment, abuse of power or discrimination in the work environment, under the terms described in item 6 below;
- Content: texts, images, documents, trademarks, layout, logos and other materials made available on the Site.
3. NATURE OF THE SITE
The Site is an institutional channel for communication and representation of STAECNON-RJ with its professional category, with no commercial purpose. The Site does not constitute, and must not be interpreted as, the provision of a paid service, legal or labor consulting, or any other professional nature. Information published on the Site (news, bulletins, public notices, institutional pages) is informational in nature and does not replace the Union's Bylaws, assembly minutes, collective agreements and conventions, or any official document physically filed at the Union's headquarters — in case of discrepancy between the content published on the Site and the corresponding official document, the latter prevails.
4. REGISTRATION AND ACCESS ACCOUNTS
4.1 General rules
When creating any Access Account on the Site, the User undertakes to:
- Provide truthful, accurate and up-to-date information;
- Keep their password confidential, not sharing it with third parties under any circumstances;
- Use the Access Account personally and non-transferably;
- Immediately notify the Union, at the e-mail given in item 16, in case of suspected unauthorized use of their account.
The User is fully responsible for all actions performed through their Access Account, except when they unequivocally prove that the improper access resulted from a security flaw attributable exclusively to the Union.
4.2 Administrative Panel accounts
Administrative Panel accounts are for the restricted use of Directors, employees and collaborators expressly authorized by the Union, each with their own access level. Sharing credentials between different people is prohibited, even if both are authorized to access the Panel — each person must have their own individual account.
5. PROHIBITED CONDUCT
When using the Site, the User agrees not to:
- Provide false or incomplete data, or data of third parties without authorization, in any form, registration or Access Account;
- Use the Site, the contact form or the Reporting Channel for unlawful, defamatory, slanderous or discriminatory purposes, or ones that violate the rights of third parties;
- Attempt to gain unauthorized access to any restricted area, system, database or third-party Access Account, by any technical or non-technical means;
- Use bots, automated scripts, scraping or any other technique to extract, copy or mass-reproduce the Content of the Site without the prior and express authorization of the Union;
- Interfere with the security, availability or operation of the Site, including attempts at overload (denial-of-service attacks), exploitation of vulnerabilities or introduction of viruses, malware or malicious code;
- Reproduce, distribute, sell or modify the Content of the Site for commercial purposes, without the prior written authorization of the Union;
- Use the Reporting Channel repeatedly, abusively or for the purpose of harming, defaming or persecuting a specific person, without real factual basis (see item 6.3).
Failure to comply with any rule in this item may result in the immediate suspension or cancellation of the Access Account involved, without prejudice to the applicable civil and criminal measures, at the sole discretion of the Union.
6. REPORTING CHANNEL — SPECIFIC RULES AND USER RESPONSIBILITY
6.1 Purpose and limits of the Channel
The Reporting Channel is an internal instrument of the Union for receiving reports of workplace bullying, sexual harassment, abuse of power or discrimination in the work environment, involving the category represented by STAECNON-RJ. The Channel is not an investigative, police or judicial body, does not replace the Police Station, the Public Labor Prosecutor's Office, the Labor Courts or any other competent authority, and has no power to impose sanctions on anyone. The Union receives the report, may seek dialogue and mediation within its sphere of union activity, and — when it deems appropriate — guide the reporting person to seek the appropriate legal avenues.
6.2 The Union neither confirms nor guarantees the truthfulness of reports
The Union acts exclusively as the recipient of the report sent by the User. The Union does not investigate, confirm, attest to or guarantee the truthfulness of any report received, and its action regarding each report is at the sole discretion of the board, within the limits of its union competence. No mention of a person, company or position within a report received through the Channel represents, in itself, an acknowledgment of guilt, responsibility or truthfulness of the reported fact on the part of the Union.
6.3 Good-faith commitment and personal responsibility of the reporting person
The Reporting Channel was designed to protect, to the maximum extent technically possible, the anonymity of those who report in good faith — the report is never linked, within the Union's systems, to whoever sent it, and the Channel requires neither an account nor a CPF (see Privacy and Cookie Policy, item 1.3). This technical protection of anonymity does not remove, under any circumstances, the personal civil and criminal liability of the reporting person for a report that proves false, slanderous or made in bad faith, under applicable Brazilian law — including, without limitation, the crimes of slander and defamation (arts. 138 and 139 of the Penal Code) and of false accusation (art. 339 of the Penal Code), as well as possible civil liability for moral damages (arts. 186 and 927 of the Civil Code).
By using the Reporting Channel, the User declares, under their own responsibility, that the report sent corresponds to facts that they believe to be true, of their direct knowledge or in good faith, and that they are not using it with the intent to harm, defame or persecute a specific person without real factual basis. The Union reserves the right, upon court order or request by a competent authority, to cooperate to the extent of its technical reach with any investigation of improper use of the Channel — always respecting the technical limits of anonymity described in the Privacy Policy.
7. INTELLECTUAL PROPERTY
All Content of the Site — including texts, photographs, videos, logos, the "STAECNON-RJ" mark and layout — is owned by the Union or by third parties who authorized its use, and is protected by Brazilian copyright and industrial property law (Law No. 9,610/1998 and Law No. 9,279/1996). Viewing and sharing content for personal and non-commercial purposes is permitted (e.g., sharing a news item on social media), always with due attribution to STAECNON-RJ. Any reproduction, distribution or commercial use of the Content without the prior written authorization of the Union is expressly prohibited.
8. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites, applications or services (WhatsApp, Instagram, Facebook, Google Maps, websites of partner federations and labor confederations, among others). The Union does not control, endorse or take responsibility for the content, availability, privacy policies or practices of these third parties. Access to these links is at the User's sole risk.
9. AVAILABILITY AND MAINTENANCE OF THE SITE
The Union uses its best efforts to keep the Site available and working properly, but does not guarantee uninterrupted availability. The Site may be temporarily unavailable for scheduled or emergency maintenance, security updates, or for technical reasons beyond the Union's reasonable control (instability of the hosting provider, connectivity failures, force majeure), without giving the User any right to compensation of any kind.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Union is not liable for:
- Direct or indirect damages arising from the temporary unavailability of the Site or any of its features;
- The content of reports sent by Users through the contact form or the Reporting Channel, the truthfulness of which is the sole responsibility of whoever sent them (see item 6);
- Misuse, by third parties, of access credentials whose custody is the User's own responsibility (see item 4.1);
- Decisions made by Users based solely on information published on the Site, without confirmation with the Union's board when the nature of the matter so recommends.
Nothing in these Terms excludes or limits rights that cannot be validly limited or excluded by law — in particular, no clause of these Terms affects the labor and union rights guaranteed to the Member by the Federal Constitution, by the Consolidation of Labor Laws (CLT) or by the Bylaws of STAECNON-RJ.
11. PRIOR PROCEDURE AND PROCEDURAL GOOD FAITH
In case of any disagreement, complaint or dissatisfaction related to the Site or its content, the User agrees, before taking any judicial or extrajudicial measure against the Union, to seek an amicable solution through the official contact channel given in item 16, granting the Union a reasonable period to respond and, when applicable, to correct the matter. This prior attempt at amicable resolution is a condition that the parties recognize as an expression of objective good faith (art. 422 of the Civil Code).
The Union repudiates, and will not refrain from requesting before the Judiciary, the liability of anyone who litigates in bad faith in actions related to the Site or the services described therein, under articles 79 to 81 of the Code of Civil Procedure, whenever any of the situations provided therein is found (asserting a claim or defense against express statutory text, altering the truth of the facts, using the proceeding to achieve an unlawful objective, among others).
12. SUSPENSION AND CANCELLATION OF ACCOUNTS
The Union may, at its discretion and without prior notice, suspend or cancel any Access Account that violates these Terms of Use, without prejudice to other applicable measures. When technically possible and reasonable, the Union will seek to inform the User of the measure taken and its reasons.
Important: the suspension, cancellation or deletion of an Access Account on the Site does not represent, and must not be interpreted as, the disaffiliation of a Member from the ranks of STAECNON-RJ — disaffiliation follows its own procedure, provided in the Bylaws, formalized in writing and signed by the Member.
13. PRIVACY
The processing of personal data carried out through the Site is governed by the STAECNON-RJ Privacy and Cookie Policy, an integral part of these Terms of Use.
14. CHANGES TO THESE TERMS
These Terms of Use may be updated periodically, at the Union's discretion, to reflect legal, technical or functionality changes to the Site. Significant changes will be communicated through a prominent notice on the Site's home page. Continued use of the Site after the publication of a new version of these Terms implies agreement with the changes.
15. APPLICABLE LAW AND VENUE
These Terms of Use are governed by the laws of the Federative Republic of Brazil. The venue of the District of Campos dos Goytacazes/RJ is elected to settle any disputes arising from these Terms, with express waiver of any other, however privileged, except for cases of mandatory jurisdiction provided by law (for example, the venue of the Member's domicile in labor matters, where applicable).
16. CONTACT
Questions about these Terms of Use can be sent to staecnon@staecnon.org.br or to the physical address given at the beginning of this document.
This document replaces any previous version of the STAECNON-RJ Terms of Use.
